1. Introduction

Welcome to Give and Get Fundraising (“Give and Get,” “we,” “our,” or “us”). These Terms and Conditions ("Terms") govern your use of our fundraising platform, donation processing, and digital collectible (NFT) issuance. By using our services, you agree to comply with these Terms. If you do not agree, please do not use our platform.

2. Services Provided

Give and Get Fundraising offers a platform that enables donors to contribute to nonprofit organizations while receiving a non-fungible token (NFT) as a donor recognition reward. We also act as our own credit card processor to securely handle donation transactions.

3. Donations & Payment Processing

Secure Transactions: Donations are processed securely through our in-house payment processing system in compliance with PCI-DSS security standards.

Credit Card Fees: Donors have the option to cover the credit card processing fee, ensuring that 100% of their donation goes directly to the nonprofit.

No Refunds: All donations made through our platform are final and non-refundable unless required by law.

Tax Deductibility: Donations may be tax-deductible depending on the recipient organization's nonprofit status. Give and Get is not responsible for providing tax advice.

4. NFT Issuance & Third-Party Wallets

NFT Rewards: Each donor may receive a unique, non-fungible token (NFT) as a recognition of their contribution.

Third-Party Minting & Wallets: NFTs are minted through a third-party provider, and donors must provide or create a compatible digital wallet to receive their NFT.

No Monetary Value: NFTs issued through Give and Get do not hold monetary or investment value and are purely for recognition and engagement purposes.

Delivery of NFTs: While we strive to issue NFTs promptly, delays may occur due to third-party processing times.

5. User Responsibilities

By using Give and Get Fundraising, you agree to:

Provide accurate and truthful information when making donations.

Ensure that you have the legal authority to use the payment method provided.

Create and manage your own digital wallet if you wish to receive an NFT.

Not misuse the platform for fraudulent activities, money laundering, or any illegal transactions.

6. Data Privacy & Security

We use encryption and security measures to protect donor information.

Payment details are not stored on our servers beyond what is necessary to process transactions securely.

7. Intellectual Property

All content, including website materials, branding, and custom artwork used for NFTs, is the intellectual property of Give and Get Fundraising or its partners. However, once an NFT is distributed, it becomes the exclusive property of the donor, who may use, display, or share it as they choose.

Users may not copy, reproduce, or distribute any other platform content without prior permission from Give and Get Fundraising.

8. Limitation of Liability

Give and Get Fundraising provides its services on an "as-is" basis and makes no guarantees regarding uninterrupted service, NFT issuance timelines, or the long-term availability of third-party wallet providers.

We are not responsible for loss, theft, or inaccessibility of NFTs due to user error, lost wallet credentials, or third-party service failures.

We are not liable for damages, losses, or legal claims arising from the use of our platform, donation processing, or NFT distribution.

9. Termination & Suspension

We reserve the right to suspend or terminate any user’s access to our platform if they:

Violate these Terms and Conditions.

Engage in fraudulent, illegal, or unethical activities.

Attempt to manipulate or misuse the platform for unintended purposes.

10. Changes to These Terms

We may update these Terms from time to time. Users will be notified of significant changes, and continued use of the platform after updates constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in Palm Beach, Florida.
